Mandatory payment of end-of-year bonus 5 days before December 25

The Ministry of Labour in Mauritius has issued a notice informing employers and employees in the private sector about the mandatory payment of an end-of-year bonus.

According to the Workers’ Rights Act, employees with a monthly base salary not exceeding Rs 100,000 are entitled to receive this bonus.

The act stipulates that employers must pay 75% of the bonus five days prior to December 25, with the remaining balance to be paid by the last working day of the year.

The end-of-year bonus is calculated as one-twelfth of the employee’s total remuneration received during the year.

It is mandatory and payable to employees who have been employed throughout the year, as well as those who have taken up employment and are still with the same employer on December 31, 2023, retirees, those who have been dismissed, or have resigned after completing a minimum of eight months of continuous service during the current year with the same employer, and those whose fixed-term contracts have ended in 2023.

In cases of retirement or dismissal due to economic or structural reasons, the end-of-year bonus is calculated based on the employee’s last month’s salary in relation to their working time during the year.

For employees earning a monthly base salary exceeding Rs 100,000, the provisions of the End of Year Gratuity Act apply for the payment of a gratuity.
