Man Wrongly Declared in 2 Marriages, and Dead!

Due to an administrative errors since 1992, a man has been declared dead, at least officially in the civil registry. He is also supposed to have been married twice, when he had only entered into one.

This is the story of Louis Jean Claude Auguste, aged 66.

He had recourse to the Supreme Court to have these incorrect details on his birth certificate removed. His lawsuit was directed against the civil registry.

This case involves the story of Louis Jean Claude Auguste (the plaintiff) and two other men with the same name residing in the same region. The civil registry issued a death certificate on October 8, 1992 in the name of the man in his sixties, even though he is alive.

Additionally, it was stated that he had been married twice, on January 30, 1974 and May 7, 1977, whereas he had only been married once, on May 7, 1977. The plaintiff’s wife had also testified in this case.

In his verdict, Judge Denis Mootoo ruled that the annotations indicating that the plaintiff had been civilly married on January 30, 1974 and that he was deceased were incorrect.

He declared that Louis Jean Claude Auguste, born on January 30, 1958, is indeed alive and ordered the civil registry to amend its records and remove the incorrect information.

Regarding the identity of the person who died in 1992, the judge believes it would be appropriate for the civil registry and authorities to make amendments after conducting an investigation.
