The representative of the Director of Public Prosecutions (DPP) office filed a “discontinuance of proceedings” motion this morning at the Port Louis court in the Private Prosecution initiated by Anwar Rehaz Noormahomed’s brother against the Prime Minister, Pravind Jugnauth, and Minister Anwar Husnoo.

Asraf Noormahomed sought justice after his brother’s tragic death, swept away by floodwaters on the Pailles highway on Monday, as he was riding back home on his motorcycle on 15th January. Asraf Noormohamed claims he took legal action to shed light on his brother’s tragic death. In an affidavit attached to his Private Prosecution, he detailed the events that occurred on Monday 15th January and before.

He accuses Prime Minister Pravind Jugnauth and Minister Anwar Husnoo of “incompetence” and blames them for failing to make timely decisions when disaster was imminent. Anwar Rehaz Noormohamed, a 53-year-old security guard, was swept away by floodwaters on the Pailles highway during the floods on 15th January.

During the hearing this morning, Me Dawoodarry argued that there is not enough evidence to proceed with a trial against Pravind Jugnauth and Anwar Husnoo. However, he mentioned that a judicial inquiry to shed light on Anwar Rehaz Noormahomed’s death could be established soon.

Asraf Noormahomed’s lawyer, Me Sanjeev Teeluckdharry, announced his intention to challenge the DPP’s decision through judicial review.
