£1 million claim dispute overturned: Morne Brabant emerges victorious

The Morne Brabant company has successfully appealed a £1 million claim dispute against Le Morne Brabant IRS Company Ltd and Société Du Morne Brabant.

The initial judgment had rejected the appeal but ordered the appellant to make the payment by August 2023.

The appeal was based on the absence of a statutory demand and uncertainties regarding its service.

The government of Mauritius is also facing international arbitration with claims amounting to Rs 2.6 billion (70 million euros) over the cancellation of a project.

The British promoters argue that policy changes have made their investments worthless.

The appellate court ruled that there was a substantial dispute over the claimed debt and annulled the statutory demand.
