Air Mauritius ordered to pay Rs150M over unjustified dismissal

Air Mauritius has been ordered by the Industrial Court to pay pilot Sheik Oumed Ali Torabally approximately Rs 149.4 million following a constructive dismissal case.

The court ruling sided with Torabally’s claim. He had been with Air Mauritius since 1981 and was serving as EVP Flight Operations until his termination in 2018.

The case had been ongoing for five years, causing significant personal and professional disruption for Torabally, who had to travel frequently for court proceedings.

“Air Mauritius did maliciously use a chimerical offer of comparable employment as a colourable device to trap Salim Torabally with a view to defeating his claim of constructive dismissal,” the Court ruled.
