Mauritius Supreme Court Rejects ex-President's Plea to Challenge Report

Mauritius’ Supreme Court has rejected former President of the Republic Ameenah Gurib-Fakim’s plea for authorisation from the Supreme Court to challenge the findings of the Commission of Inquiry led by former Chief Justice Asraf Caunhye.

“The request for authorisation must be rejected as it was not filed in a timely manner. We have also examined whether there are any arguable grounds with a realistic chance of success presented in the supporting affidavit for any of the other grounds of the motion. Indeed, there is no substantiated basis in support of any of the applicant’s contentions or claims mentioned in her affidavit. Therefore, the application for leave is dismissed,” wrote Chief Justice Rehana Mungly-Gulbul in her judgment.

The Commission of Inquiry, led by former Chief Justice Asraf Caunhye, submitted its report on September 16.

It concluded that the former President acted in violation of the Constitution when she decided to establish an inquiry commission in connection with the Sobrinho scandal, against the advice of Senior Officers and her own legal advisors.
