Supreme Court to hear debates on controversial Immigration Law on July 28

The Supreme Court is set to be the stage of a heated debate over the constitutionality of the controversial new immigration law as political and social activist Lindsey Collen-Seegobin pushes forward with her constitutional complaint.

The challenge of Collen-Seegobin, a founding member of the Muvman Liberasyon Fam, targets the State, Prime Minister Pravind Jugnauth, and the Attorney General as defendants.

She is contesting  the controversial Article 39 (4) (F) of the new immigration law, as well as Article 11 (8) of the Mauritian citizenship law, that gives the Prime Minister the authority to revoke Mauritian citizenship from whoever is not Mauritian by birth.

To bolster her case, she has enlisted the legal expertise of Me Antoine Domingue, Senior Counsel and Me Ayesha Jeewa.

However, objections have been raised by the State and the Prime Minister, who argue that Collen-Seegobin lacks the grounds to challenge the law, failing to demonstrate any violation of her rights. Moreover, the defendants argue that her challenge appears to be a collective action on behalf of other citizens, a move that is not permitted under existing laws. 

Debates in the case are scheduled for July 28.
