Supreme Court nullifies appointment of 13 Lead Analysts at Ministry of Finance

The Supreme Court has nullified the promotion of 13 Lead Analysts at the Ministry of Finance in 2019, in an oral ruling by judges Gaytree Jugessur-Manna and Karuna Devi Gunesh-Balaghee on Friday, November 3rd, 2023.

The ruling came after the Public Services Commission (PSC) and six Chief Analysts at the Ministry of Finance appealed to the Supreme Court for a judicial review of the decision made by the Public Bodies Appeal Tribunal (PBAT), which had previously voided the promotion of the six Chief Analysts at the Ministry.

This was after three other Analysts had filed a complaint with the PBAT challenging the PSC’s decision to appoint 13 analysts to the post of Chief Analyst at the Ministry.

In its 2020 decision, the PBAT found that three of the promoted Chief Analysts did not possess the required qualifications for the post and that three more lacked the necessary experience, citing Article 14(1)(c) of the Public Service Commission Regulations and the Appadu v PSC 2003 judgement.

Judges Gaytree Jugessur-Manna and Karuna Devi Gunesh-Balaghee noted that they had observed “disruptions” in the PSC’s mark sheet, which were not in line with Article 14(1)(c) of the Public Service Commission Regulations.

Thus, they annulled the entire selection exercise conducted by the PSC for the promotions at the Ministry of Finance.
