Court rejects Alteo/Qair's Judicial Review request over CEB tender cancellation

The Supreme Court has rejected Alteo Ltd and Qair International SAS Ltd’s Judicial Review requests after the Central Electricity Board (CEB) cancelled a wind farm electricity procurement tender exercise.

Alteo/Qair claimed the CEB unreasonably rejected its offer that altered the Model Energy Supply and Purchase Agreement (ESPA) terms, and its proxy given to represent Qair wasn’t notarised.

Nevertheless, the Court ruled the CEB’s decision didn’t have fraud, corruption, or bad faith allegations and was not illogical or irrational.

The CEB’s Request for Proposal Document says it can reject an offer, meaning the cancellation of the tender exercise is valid.
