Navin Ramgoolam’s Legal Win Against State: Rs 225 M, One Step Closer
In a legal case involving former PM Navinchandra Ramgoolam against the State, the Police Commissioner, and Hemant Jangi, an interim decision by Judge K. D. Gunesh-Balaghee today, March 14th, took a favorable turn for the former government leader.
The dispute revolves around Navin Ramgoolam’s claim for Rs 225 million in damages against the defendants, accusing them of a series of unjust, illegal, and politically motivated acts committed against him by state agents.
In a key argument, the plaintiff’s lawyers argued that the actions taken by the defendants were solely intended to discredit and humiliate their client, while the defense lawyers tried to challenge the validity of the complaint, arguing that Navin Ramgoolam was under judicial control at the time of the alleged events.
However, the judge’s decision, issued on March 14, 2024, dismissed the initial objection of the defendants, stating that the provisional charges were brought by the police, not the magistrate.
The judge emphasized that the magistrate’s role was to place the detainee under judicial control and not to determine the validity of the accusation.
This decision marks a significant initial victory for Navin Ramgoolam, reaffirming his right to pursue legal action against the alleged acts of political persecution against him.
The legal battle continues, but this interim decision strengthens the former Prime Minister’s position in this case.
