Activist Withdraws Citizenship Case After 2 Promised Law Reforms

On Friday, May 23, 2025, activist Lindsey Collen Seegobin officially withdrew her constitutional challenge against the Mauritian government, the Prime Minister, and the Attorney General. The case was heard in the Supreme Court.

Lindsey Collen has been challenging the constitutionality of section 11(8) of the Citizenship Act and section 39(4)(f) of the Immigration Act 2022, arguing that these provisions infringe on her fundamental rights.

During the hearing, lawyer Kamlesh Kumari Domah, representing the government, announced that legislative amendments would be made to the Mauritian Citizenship Act.

These changes aim to address the contested provision allowing the Prime Minister to revoke a person’s citizenship without needing to justify the decision.

Satisfied with this commitment, Seegobin’s lawyer, Jean Claude Bibi, requested the court to dismiss the case.

Judges David Chan Kan Cheong and Karuna Devi Gunesh-Balaghee approved the request. The case was struck off the court docket, and no costs were awarded to either side.
