2 Key Bills Amendment Transform Justice: No More Crime of Passion

A pivotal moment for the Mauritian judicial landscape, the Constitution (Amendment) Bill and the Criminal Code (Amendment) Bill are poised for introduction in the National Assembly. These legislative efforts signify a vital undertaking towards reform, aiming to restore the sanctity of our legal framework while strengthening the safeguarding of fundamental rights.

The proposed Constitutional amendment seeks to abolish Article 7(2), which has historically permitted laws that allow the imposition of inhumane and degrading treatment.

This initiative represents a definitive rejection of any legislation endorsing torture in any capacity.

Such an amendment is not merely a technical adjustment; it is a crucial response to the compelling recommendations made by the United Nations Committee Against Torture during its examination of Mauritius’ fourth periodic report on 30th November 2017.

Moreover, the reforms extend beyond constitutional matters. The Criminal Code (Amendment) Bill is aimed at addressing the deeply ingrained issue of the “crime of passion” defence.

Under the proposed changes, any homicide committed by an individual against their spouse or partner during the act of adultery will no longer be deemed excusable.

This significant decision, ratified by the Cabinet in its recent meeting, represents a steadfast commitment to challenging the trivialisation of human life and the emotional rationalisations for acts of violence.
