Business Mauritius to Challenge New Wage Regulations in Court
On September 27, Business Mauritius announced its decision to pursue a Judicial Review concerning the recent wage adjustment regulations issued by the Ministry of Labour. The association, representing the private sector, aims to seek clarity on the legal principles governing the powers of a minister as defined in Articles 94 and 106 of the Employment Relations Act (ERA) and their relationship with Articles 91 to 93 of the same legislation.
In a statement, Business Mauritius emphasized that this review is intended to ensure that any future actions comply with legal parameters and that all stakeholders maintain a consistent understanding of the regulations.
The association has advised its 1,200 members to make their own decisions regarding wage adjustments, taking into account their individual circumstances and specific needs.
While Business Mauritius has consistently supported wage adjustments related to relativities and remains committed to the interests and well-being of employees as well as the country’s development, it reaffirmed its dedication to fostering dialogue between the public sector, the business community, and employees.
