Duplex Purchase Conflict: Tourism Authority Director Claims Fraud

Lindsay Morvan, the Director of the Tourism Authority, is voicing allegations of fraud in relation to the purchase of a duplex. Morvan and his wife were searching for a new home that would be smaller and more suitable for their needs. After selling their property in Baie-du-Tombeau, they had high hopes of moving into a duplex promised by Areva Immobilier Ltd.

However, those hopes have turned into a nightmare, as the project delivery, originally scheduled for June 2022, has yet to occur.

In total, Morvan paid Rs 5.2 million, including an initial payment of Rs 1.8 million, but now finds himself in a precarious situation.

He has moved temporarily into his son’s home, with their belongings still packed in boxes after two years of waiting. “My wife and I are essentially squatting in our son’s house.

We thought it would be a short stay until our duplex was ready. Despite numerous inquiries, I still have no idea when it will be completed,” he lamented.

Frustrated by the apparent lack of progress, Morvan has taken legal action.

“I have served a notice of default through my lawyers and also filed a police report. A few days ago, the police informed me that the investigation is nearing completion, and the case will soon be sent to the Director of Public Prosecutions,” he added.

In response to the claims, Areva Immobilier Ltd attributed the delays to circumstances beyond their control.

The company stated that they have adhered to the terms of the contract and requested extensions due to challenging weather conditions and other reasons.

“We have acted in good faith. We have kept buyers informed about the delays through newsletters,” the company’s management said.

The directors of Areva Immobilier Ltd expressed confusion over Morvan’s response, noting that he initially requested them to resell the duplex and refund his money but is now focused on the delivery timeline.

“We are unclear about what he wants exactly,” the management explained, emphasizing that the contract allows the builder to request an extension of time.

Areva Immobilier Ltd further insisted that Morvan’s allegations of bad faith have led to the police complaint and negative social media commentary. The situation remained under investigation.
