New Mauritius Hotels loses case in Privy Council
New Mauritius Hotels (NMH) has lost its appeal in the Privy Council against a Supreme Court ruling that awarded severance pay to a former maintenance manager, Michel Lafresiere.
NMH had terminated Lafresiere’s employment in 2013, alleging his failure to attend a disciplinary hearing.
The Privy Council upheld the Supreme Court’s decision, citing NMH’s inadequate presentation of evidence and the magistrate’s failure to critically analyze conflicts.
Additionally, the Industrial Court did not examine whether other employees faced similar consequences for misconduct.
This ruling highlights the importance of clarity in judgments and ensures fairness in employment disputes. NMH is now required to compensate Lafresiere accordingly.
