Privy Council appeal against PM Jugnauth : High-stakes showdown on July 10

In a significant development, it has been confirmed that Suren Dayal, the defeated candidate of the Labour Party in the general elections held on November 7, 2019, will have his appeal debated before the Judicial Committee of the Privy Council on July 10, 2023. The hearing is scheduled to take place over a single day.

This announcement was made on May 18 on the official website of the Privy Council, l’Express reported.

The appeal will be presided over by Lord Reed, the President of the Judicial Committee. He will be joined by four other Law Lords, namely Lord Lloyd-Jones, Lord Sales, Lord Hamblen and Lord Stephens.

Dayal has accused the three MPs of Constituency No. 8 (Moka/Quartier-Militaire) in the November 7, 2019 general elections of bribery, treating, and undue influence. Suren Dayal is challenging, before the Privy Council, the decision of Judges David Chan and Karuna Devi Gunesh-Balaghee to dismiss his election petition filed against Prime Minister Pravind Jugnauth, Leela Devi Dookun-Luchoomun, and Yogida Sawmynaden.

Suren Dayal finished in fourth place.

He is appealing under Articles 45, 64, and 65 of the Representation of the People’s Act, seeking the highest judicial authority to declare the election of Pravind Jugnauth, Leela Devi Dookun-Luchoomun, and Yogida Sawmynaden null and void.

Suren Dayal has indicated that the Prime Minister made promises during the electoral campaign to increase the basic retirement pension and accelerate forms of public sector pay, including performance bonuses for police officers, firemen, and prison officers.

Additionally, Suren Dayal alleged that the Prime Minister pledged to compensate victims of a ‘Ponzi scheme’ with Rs3 billion if his government returned to power – which according Tim amounted to ‘bribery’.

The appellant also highlighted that the provision of food, drink and entertainment at an event organised by the Ministry of Social Security at which Pravind Jugnauth spoke constituted treating.

He further accused the trio as having engaged in undue influence of voters by fraudulent contrivance through misuse of the Mauritius Broadcasting Corporation (MBC).

The MBC, he alleged, was utilised as a propaganda machine in favour of this alliance.

The hearing before the Judicial Committee of the Privy Council is expected to be a significant moment in this ongoing legal battle.

The outcome of the appeal, if in favour of Dayal, could have far-reaching implications for the political landscape of Mauritius. One of these would be the destitution of PM Pravind Jugnauth as an elected Member of Parliament.
